Welcome!

Welcome. Below, you will find important information about family law and my practice as a family law attorney. You will also find a blog concerning Minnesota Supreme Court and Court of Appeals decisions, especially as they relate to family law matters. Sometimes, I also summarize business related cases.

I meet with clients during regular business hours, evenings and weekends.

Your Experiences

Family law usually enters a person’s life at a time of upheaval. A marriage, living arrangement or domestic partnership collapses; the collapse having come on quickly or developed over a long period of time. A former spouse stops paying support for you and the children, or has never done so, and must now live up to her or his legal obligations. Your parenting time is being interfered with. Your children are endangered by their other parent, and they need to come more fully into the safety of your care. Now you have decided to defend your rights, your role as a parent, and your children.

My Strengths as Your Attorney

I collaborate with my clients. I advocate and defend your interests. I believe in settling cases if possible, and going to court if necessary. I don’t believe in forcing or maneuvering a client to settle. I will always advise you from my experience and knowledge of the law, without varnishing the truth. I maintain good communication with my clients and will keep you informed. I respect your decisions within the bounds of my ethical obligations as an attorney.

Our Goal

Family law encompasses all of these personal experiences and many more. In working with you, our goal is to seek legally enforceable and reasonable solutions to these problems.

I can help you find these solutions through my experience as an attorney and former Guardian ad Litem. Your situation has unique facts. My job is to work with you, advise you as to how the law might help you, and how a court may likely respond to your problems.

I will then advocate, with determination, your case with the other party or in court. I consider it an honor to do so.

Legal solutions range from negotiated outcomes to a judge’s decision. A negotiated outcome, if possible, can provide a more satisfactory solution than a court decision. Often, solutions are a mixture of successfully negotiating some issues and trying the remaining issues in court. In fact, many family law cases never go to court, but if we need to, we will go to court. Most cases never go to trial, but if we need to, we will go to trial.

Flat Fee Divorce

I will charge a flat fee for both parties if you and your spouse have agreed on all of the relevant issues concerning your divorce. The flat fee will cover my collecting the necessary information, drafting the required documents and guiding you through the process. I can tell both of you what the law is, but I will not be able to advise you individually. Agreed upon issues would include any combination of the following, or other issues not listed here:

  • Child custody
  • Parenting time
  • Child support-this is usually determined by a legal formula
  • Activities fees
  • Spousal maintenance
  • If a house is owned by you and your spouse, the following questions will have to be agreed upon. Who will occupy the house? How will title be handled? How will equity in the house be divided? Will the house have to be sold at some point? This is not a complete list.
  • Division of personal property, such as automobiles, furniture, electronics, books, equipment, tools, photographs, collections and jewelry. This is not a complete list.
  • Division of financial assets, such as savings accounts, checking accounts, retirement plans, investment accounts and portfolios. This is not a complete list.
  • Any equalization payments
  • Division of responsibility for debts
  • Health care coverage

If your case develops undecided issues while I am working with both of you, one of two things will happen:

1. We will stop the process until you and your spouse decide the issues within a reasonable time through personal discussion or outside mediation, or
2. If you cannot decide the issues within a reasonable time, I will withdraw from your case and I will charge for my time against the flat fee, but not beyond the amount of the flat fee.

THE ABOVE IS NOT A LEGAL CONTRACT AND THE CONTRACT FOR MY SERVICES WILL BE ADAPTED TO YOUR NEEDS.
